{"id":586,"date":"2018-08-06T07:00:41","date_gmt":"2018-08-06T07:00:41","guid":{"rendered":"https:\/\/tysllp.com\/?p=586"},"modified":"2023-10-09T17:35:45","modified_gmt":"2023-10-09T17:35:45","slug":"property-state-and-local-taxes-are-still-deductible","status":"publish","type":"post","link":"https:\/\/tysllp.com\/property-state-and-local-taxes-are-still-deductible\/","title":{"rendered":"Property, state and local taxes are still deductible, up to a point"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A momentous change took place last December 2017 in the form of the Tax Cuts and Jobs Act (TCJA), which is the tax reform bill that placed a new limit on deductions for state and local taxes, including property taxes. \u00a0Previously these deductions were unlimited for individuals, though many people who owed the alternative minimum tax lost the benefit of some of these write-offs. So, what does this mean for the typical homeowner? <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Quite simply, it means taxpayers can deduct property taxes you pay in 2018 on your 2018 tax return, if you did not pre-pay them in 2017. And, future years will remain deductible. The only exception is that beginning with tax year 2018, you can only deduct the first $10,000 of your combined property and state income taxes if they exceed that amount. The government capped the deduction amount at $10,000 as a combined limit. <\/span><span style=\"font-weight: 400;\">Now, the two taxes have a single combined limit, so taxpayers in income tax states could lose all or part of their property tax deduction even if their property taxes are below $10,000. This limit goes into effect for 2018 taxes to be filed in April 2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although it sounds complicated, the provisions are straightforward to understand. Taxpayers may receive the deduction if they are the owners of the property and it is for personal use. You must itemize deductions to receive this property tax break. Here are a few additional items to note:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Deductible property taxes include taxes paid at closing when buying or selling a home, as well as taxes paid to your county or town\u2019s tax assessor (either directly or through a mortgage escrow account) on the assessed value of your property.<\/span><\/p>\n<p><b>You may deduct it for your:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Main home<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Vacation homes<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Land<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Foreign property<\/span><\/li>\n<\/ul>\n<p><b>You cannot deduct it for:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Property you don\u2019t own<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Rental property or business property (claim it as an expense, not a deduction)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Local improvements, like streets or sidewalks<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Trash collection, library taxes, or anything else not directly related to property value<\/span><\/li>\n<\/ul>\n<p><b>Some more important info:\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If you pay your property tax with your mortgage, you can only deduct it after your lender has paid the tax on your behalf. You can contact your lender to find out when they typically make these payments. (For example, a lender might make the payment in October to cover the total amount of the following year\u2019s taxes; or they might make quarterly payments. It depends on the taxing authority in your location.)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Co-op members: Only claim your share of the amount paid by the corporation<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">These TCJA changes may unfavorably affect individuals who pay high property taxes because they live in high-property-tax <\/span><span style=\"font-weight: 400;\">areas like Manhattan, San Francisco, and Seattle, <\/span><span style=\"font-weight: 400;\">own an expensive home (resulting in a hefty property tax bill), or own both a primary residence and one or more vacation homes (resulting in a bigger property tax bill due to owning several properties). Individuals in these categories can now deduct a maximum $10,000 of personal state and local property taxes \u2014 even if they deduct nothing for personal state and local income taxes or general sales taxes. <\/span><span style=\"font-weight: 400;\">Various calculations have shown that high income earners who live in this type of high value area will likely take a hit on their tax bill for this area if their state and local taxes exceed $35,000.<\/span><\/p>\n<p><a href=\"http:\/\/www.tax-rates.org\/taxtables\/property-tax-by-state\"><span style=\"font-weight:
